Hungary’s government will initiate amending the constitution to limit the freedom of expression by restricting racist expression, Prime Minister Ferenc Gyurcsany told news portal Hirszerzo on Monday morning.
The PM spoke in response to Constitutional Court President Peter Paczolay’s recent statement that the Court would defend the freedom of expression. Paczolay said he would not consider restrictions even if harsher expressions than the much-disputed phrase “Gypsy crime” was used, which many consider to fall into the category of hate speech.
Gyurcsany said he did not agree with Paczolay’s views.
“My view is completely different from that. If a concept qualifies a whole group of society as criminals or makes its members feel scapegoats, then it violates the identity of that group and the dignity of its members,” Gyurcsany said.
The prime minister also cited a recent report by the Council of Europe, which said that Hungary’s laws were too liberal on the freedom of expression to make a legislation against racist expression possible.
Justice Minister Tibor Draskovics told reporters that the five-party talks on the planned constitutional amendment could start on Tuesday and the bill could be tabled in parliament as early as next week.
The main opposition Fidesz party said that it was not constitutional amendment but more stringent punishments that would help ensure public safety.
“Harsher penalties to deter criminals, faster court procedures and immediate reinforcement of the police are necessary,” Robert Repassy, a senior Fidesz official, told reporters.
Leader of the liberal opposition Free Democrats Gabor Fodor said they would examine the proposal in detail, but in general his party safeguarded the integrity of the constitution and did not favour its amendment unless it was absolutely necessary.
Leader of the small conservative opposition Democratic Forum Ibolya David said the issue required careful examination and they would comment once more details were known.
Amending the Constitution requires parliament’s two-thirds majority.

I fully agree with Gyurcsány on this. It’s unfortunate that it’s come to this but if some Hungarians need legislation to tell them how to behave then so be it.
