Budapest mayor remains out of jail despite prison sentence

The former deputy mayor of Budapest’s District X (Kőbánya) was arrested four years ago and sentenced to two years in prison after pleading guilty in a bribery case involving millions of forints, yet to date has not spent a day behind bars, writes index.hu.

Despite a court ruling that there could be no further appeals against the decision, Csaba Kaszab’s attorney submitted a request for “review” to the Supreme Court, which then overturned the sentence and called for new proceedings. The Budapest Court told the portal that new proceedings were underway but no more information was available at this time.

Kaszab, a member of the Socialst Party, made the local government pay for unmade reconstructions as president of the district’s asset manager company. The business which issued fictitious invoices transferred a total of Ft 17 million (€62,300) to Kaszab’s company.

    If the Supreme Court overturn any sentence it has good reasons to do that.
    What one can question is why lower courts could sentence on a case that had obvious some strange things in it. A court that has its sentencing overturned in this way did obviously not do a good job.
    One should more ask why the original courts did so bad job by opening themselves for a later over-ruling?
    To spare us from the normal conspiracy theories, just point out where the Supreme Court actually helped the Govt, because that is what the conspiracy will be about. A small guy who is accused of stealing 17 MHUF, big deal.
    The article plays on/lend itself to these conspiracy theories by putting the word “review” in quotation marks.

    Why does a court need to rule that there can be no further appeals? Isn’t there legislation which defines what avenues are open to a convicted person? I’m just curious!

    Not that is abnormal in any sense. I think this that a “court ruling that there could be no further appeals against the decision” are to stop the old Hungarian (or is actual an Austrian?) tradition of always open another case if you lost the first one.
    Hungarian Law as I understand is very much based on Austrian Law tradition, which would not be a real surprise for anyone.
    The right to ask for the Supreme Court to look into a case is something that is open for every one who has lost all other legal ways to continue its case. It is though in the Supreme Courts discretion to chose to look into a case or not. They will only look into the case if they think the request could have a chance to change the earlier rulings, so you really need to have a bomb-shell in the request to get their attention.
