Constitutional Court judge says new constitution to favor “medieval” laws

Hungary’s new constitution, which will become effective on January 1, 2012, says the Constitutional Court has to make its decisions in accordance with the constitution, its preamble and Hungary’s “historic constitution,” Constitutional Court Judge István Stumpf pointed out at a recent conference in Eger. He added this meant that the top court could base decisions on medieval laws such as the Golden Bull of 1222 or the “Blood Contract” of the 9th century, said to be Hungary’s founding legal code.

Stumpf, who earlier served as head of the Prime Minister’s office in Fidesz’s first term in office, also said that the government’s drive to reduce the Court’s rights had left “an open wound” on constitutionalism.

Gee, it’s almost as if Orban is trying centralise power around an all-powerful, single party, system or something.

he is not TRYING! the result will be that Hungary will have the same party in Govt for the next 20 years!!! He changed the rules of constitution, the national bank, the electoral rules, created a law to supervise media with a board full of Fidesz people and now fidesz is appointing their friends had of theaters and ‘cultural’ institutions…there will be nothing left, get used to it ’cause Orban is now the ‘Dear Leader’!

No, it just started again, then we are back to Good Ol’ Kadar, when we put the trust in the Party and the State (in that order), then they must be inseparable

    @ contraflow

I understand you are not a fan of “the Supreme Leader” however, this article lacks an explanation

re: “He added this meant that the top court could base decisions on medieval laws such as the Golden Bull of 1222 or the “Blood Contract” of the 9th century, said to be Hungary’s founding legal code.”

What on earth does that mean? Is there a concrete example
of how a court decision could be made to demonstrate the allegation or is this all about some meaningless preamble to the legislation?

Orban may very well be dragging the country back to the middle ages but this article sure doesn’t tell you how.

If I recall correctly, this man Stumpf was appointed as an Orban poodle to the court even though he is not qualified to sit on it. He is either brave or stupid to be questioning our Great Leaders approach to constitutionalism.
