Judges’ association rejects government claim of involvement in lowering of retirement age

The Association of Hungarian Judges (MABIE) firmly rejects statements the government spokesman made in a television programme concerning the organisation’s involvement in the issue of lowering the mandatory retirement age of judges, the organisation said in a statement released to MTI on Wednesday.

According to the interview posted on the website of commercial channel ATV, Andras Giro-Szasz said on Tuesday evening that the government had drafted legislation on lowering the retirement age to 62 years from 70 on the initiative of the association.

A clause on the retirement age of judges has been included in Hungary’s new supreme law and has drawn criticism from the European Commission.

In the interview Giro-Szasz said that the association had held consultations with the government several times and had sent a letter to the European Commission expressing support of the profession to the issue.

The spokesman noted that out of Hungary’s 2,800 judges 1,800 were registered as MABIE members.

In a statement, the association firmly rejected the claim it had initiated lowering the retirement age, adding that the organisation had not participated in the constitution’s drafting process at all. In fact it had protested against legislation on lowering the retirement age when it became familiar with details of the draft constitution, the statement said, adding that they called on Giro-Szasz to withdraw his remarks.

Giro-Szasz, in response, apologised in a statement his office sent to MTI. It said that, contrary to the spokesman’s earlier statement, the inclusion of the retirement age regulation had not been made by the association.
